Confidentiality

It is imperative that your business is able to enforce legitimate restrictions on the ability of employees to harm the business, for example by the misuse of confidential information or by breaching restrictive covenants which, for example, limit the ability to compete or to take key members of staff.   • Obtain advice on the extent to which the activities of employees and former employees can be restricted in accordance with the laws of the relevant jurisdiction.
  • Obtain advice on the extent to which the use of confidential information can be restricted in accordance with the laws of the relevant jurisdiction.
  • Collect any evidence that employees have acted in breach of restrictive covenants or confidentiality provisions.
  • Obtain legal advice on your ability to prevent the activities being undertaken or threatened or to recover loss caused by such activities.
  • Consider communications with customers or the media to address the public relations aspects of possible threats to the business.
