Industrial dispute / strike 

At times it is necessary to make decisions that benefit the business but which are unpopular with the workforce. These decisions may result in a dispute and, in jurisdictions which permit such action, may result in possible strikes or other industrial action with or without the involvement of a trade union. In the current economic climate this is a particular concern. It is essential that workforce disputes are managed immediately to limit potential damage, to protect relations with the workforce and to avoid negative PR.

We recommend that businesses operating in jurisdictions which permit strike and/or trade union activity, the following key steps be taken in the event of an actual or threatened strike or similar action:

  • Nominate a person or team to manage communications with employees, the union and external parties, such as the media. All information requests from internal or external sources should be referred to that person or team.
  • Identify which union is supporting the action.
  • Identify which employees are involved in the action and whether they are members of the union supporting the strike, members of a different union or non-union members.
  • Collect all information and communications relevant to the dispute in order to consider legal steps to prevent the planned strike and possible action against employees or the union involved.
  • Obtain legal advice for the relevant jurisdiction before taking action against employees.
