Whistleblowing

"Whistleblowing" is a term used to describe circumstances in which a worker, in good faith, informs his employer or a regulator, lawyer or other responsible person about events or activities which are illegal, contrary to regulation or policy, or dangerous.

With whistleblowing becoming more common, many countries, but by no means the majority, now have legislation to protect workers who disclose such wrongdoing. Some of the questions you will need to consider to ensure you are prepared for such incidents are set out below:

  • Do you have knowledge of whistleblower legislation in the jurisdictions in which your business operates?
  • What provision is made for external whistleblower reporting and is this locally compliant?
  • Does your business culture encourage openness? How do you test this?
  • Do you know if or where anonymous disclosures can be made?
  • Are you aware of what actions can amount to discrimination against a whistleblower?
  • How do you deal with the reputational impact of whistleblowing?
